Student transfers under review
Re: your May 27 editorial, "Fillmore puts caps over kids”:
I am writing to applaud the Ventura County Board of Education for its willingness to reconsider interdistrict transfer appeals filed by Fillmore parents.
After hours of arduous study of the State Education Code, two local attorneys have clarified the issues surrounding Fillmore Unified School District's transfer policy. It has become apparent that FUSD erroneously applied the "3 percent cap" to all transfer requests. This had the effect of rendering oversight by the County Board of Education impotent and tied the board's hands in reviewing appeals.
As The Star's May 27 editorial asserted, FUSD's policy is wrong, and, as it turns out, it is, in large part, not even legal. Armed with this better understanding of the various Education Code provisions that apply to interdistrict transfers, the county board does have the power to override FUSD's improper denial of transfer requests.
This is a complex issue. Now that it has been clearly analyzed, I am confident the County Board of Education will do the legal, right and fair thing by granting the interdistrict transfer appeals.
